و اتفقا و هما بكامل الاهلية و اتم الاوصاف القانونية اللازمة على الالتزام بهذا العقد راضين مختارين له، مقدمينه على كل ما سواه من عقود- إن كانت هناك عقود قد سبقته، و تنفيذ بنوده و شروطه التالية:

1- طـبيـعــة الـعـــــــمــــــل:

يوظف الطرف الاول الطرف الثاني على و ظيفة : سائق منزل خاص ليعمل لديه في المملكة العربية السعودية ، و يخضع الطرف الثاتي في عمله لانظمة الوظيفة المتعارف عليها (سائق منزل خاص) و ما يضيف اليها الطرف الاول، و تشمل: قيادة سيارات الطرف الأول لتوصيله أو عائلته و من يأذن لهم كضيوفه الى الاماكن التي يحددها له. و تقع على الطرف الثاني مسؤولية العنايه بالسيارات و نظافتها و سلامتها من التلفيات و الأعطال المتعمده، كما تشمل واجباته الرعاية الدورية لنظافة المنزل و النباتات، و المحافظة على أمن و سلامة المنزل و أصوله و مفاتيحه و جميع العهد المؤتمن عليها فيه. و يتعهد بالمحافظة على تنفيذ كل ما ذكر بأمانة و عناية مخلصة دون مخالفة لانظمة المملكة و خاصة قوانين المرور، و يتحمل مسؤولية أيّة تلفيات أو خسائر و أضرار تحدث لممتلكات الطرف الأول نتيجة أي تقصير أو اهمال.

2- مـــــدة الـعــــــقـــــد و أولويته على ما سواه:
أ‌- يسري هذا العقد لمدة سنتين ميلاديتين تبدأ من وصول الطرف الثاني الى المملكة في و تنتهي في
و هو نافذ منذ تاريخ مباشرة الطرف الثاني لمسؤوليات عمله المبلغة له بهذا العقد و ما يضيفه له الطرف الاول
ب‌- ينسخ هذا العقد كل ما سواه و يعتبر المرجع الوحيد للعلاقة بين طرفيه الموقعين، و اتفق الطرفان و تراضا على الالتزام بمقتضياته و نبذ كل ما سواه- و ان المتمم لما اغفله، هو نظام العمل و العمال السعودي. و أن مرجعية التحكيم الشرعي (لما لم يرد في بنوده بوضوح) ينظر لدى الشرع الحنيف بالمملكة فقط.


3- الراتب الشهري الاساسي و الفوائد:

يلتزم الطرف الاول للطرف الثاني نظير قيامه بشكل ممتاز بكافة الاعمال المنوطة به حسب الاتفاق بـــ :
أ‌- دفع راتبا اساسيا بنهاية كل شهر ميلادي قدره ( 1000 ) ريال سعودي.
ب‌- دفع بدل أكل شهريا (مادام في الخدمه) قدره ( 300 ) ريال سعودي
ت‌- منحه أجازة لا تقل عن شهرين بعد إكماله 24 شهرا في الخدمه، مع دفع راتب شهر واحد اضافي (دون بدل الاكل) كبدل إجازة- مالم يتم يتفق الطرفان على تأجيل الإجازة الى فترة لاحقة
ث‌- توفير سكن مريح مكيف و مؤثث، مزود بدورة مياه بسخان، و مكان للطهي
ج‌- توفير الرعاية الطبية الأولية
ح‌- تذكرة ذهاب و إياب لمدينة الاستقدام في البلد التي وفد منها الطرف الثاني، شريطة إتمامه كامل مدة العقد (24 شهرا ميلاديا)


4- فترة الفحص والتجربة :

يخضع الطرف الاول الطرف الثاني لفترة تجريبية مدتها من ثلاثة. و للطرف الاول الحق في انهاء خدمات الطرف الثاني خلال تلك الفترة باعتباره مخلا بالعقد و يطبق عليه البند (5) فقره (أولا)، كما تسري الشروط في المدة ما بعد الثلاثة شهورالباقية الى نهاية العقد في حالات:
أ‌- عدم إلمام الطرف الثاني بتنفيذ العمل و السياقة بشكل آمن و صحيح
ب‌- تعمد إتلاف العهد و التسبب في الاضرار بممتلكات الطرف الثاني، و التي تم تبليغه بطرق المحافظة عليها
ت‌- الهروب من مكان العمل و مخالفة أنظمة العمل السعودية، بالعمل لدى الغير، أو القيام بأعمال اضافية للغير دون علم الطرف الأول لغرض تحقيق أجر إضافي.
ث‌- سوء السلوك و لاخلاق و الادب، و عدم احترام اصول و اداب التعامل بحسب الدين و التقاليد المرعية في البلد
ج‌- حصوله على رخصة قادة غير صحيحة و صالحة، و ارتكابه مخالفات السلامة المروية
ح‌- وجود مرض عضال أو معدي أو معيق له عن أداء عمله
خ‌- عصيان و رفض أو تعمد الإهمال و التقاعس في أداء مهام و طبيعة عمله (بند 1) المستقدم لأجلها و الموقع عليها في هذا العقدأو مخالفته لأي من بنود هذا العقد

5- إنهاء عقد العمل و الشروط الجزائية:

لدفع ادّعاء الغرر و الشك و الجهالة من قبل الطرف الثاني، و لضمان جدّية الالتزام بمضمون العقد و محتوياته و القيام بها خير قيام ، فقد أطلع الطرف الأول الطرف الثاني على التكاليف المتكبده نظير استقدامه الى المملكة للعمل لصالح الطرف الثاني منذ أول يوم تم اللقاء به و مقابلته للوظيفة، و قد عرف تفاصيل تلك المبالغ و مجملها، و أقر بعلمه بها و موافقته عليها، حتى يكون على معرفة بعواقب الشروط الجزائية التي سيتحملها في حالة إخلاله بالعقد، كما سترد في الفقرة (ثانيا) من هذا البند (5)، و مجملها مبلغ ( ) ريــال سعودي، تفصيلها حسب لحالتين التاليتين:

 الحالة الأولى: إذا كان ترحيله قبل مضي ثلاثة أشهر على قدومه، و استخراج وثائق الإقامه و العمل له، و تدريبه، فيتحمل الطرف الثاني إجمالي ما تكبده الطرف الأول (أن كان قد دفعها لمكتب الاستقدام في بلد الطرف الثاني)، و يشمل ما يلي:
• رسوم مكتب الاستقدام في بلد قدوم الطرف الثاني ريال 5000
• رسوم دولة الاستقدام (مكتب العمل) ريال 2000
• الفحص الطبي في بلده ريال 300
• رسوم و ضرائب أخرى محصلة في بلده ريال 2000
• تذكره إعادته من المملكة الى بلده ريال 1700
الاجمالي 11000 ريال

 الحالة الثانية: أما إذا تجاوز الفتره التجريبيه، فيضاف الى التكاليف المذكورة في الحالة الأولى تكاليف استخراج الوثائق و التدريب، مثل:
• الإقامة 500 ريال
• الرخصة 500 ريال
• التأمين 0 ريال
• التأمين الطبي 0 ريال
• التدريب 1000 ريال
• أية غرامات أو سلف أو عهد مسجلة على الطرف الثاني، و لم يعيدها الى الطرف الأول ريال
