in case of expiration of this Agreement for any reason whatsoever, the Lessee must vacate the Premises and leave them free and at the disposal of the Lessor. in the event that this obligation is not complied with the Lessee must pay the Lessor a daily penalty for damages during the period of undue occupation of the property for an amount equivalent to four times the daily Rent and added monthly payments in force on the month prior to the date on which the Lessee begins the undue occupation without prejudice to any legal action that the Lessor may take in order to take over the Premises and be paid of the sums due by the Lessee, until the date the Premises are vacated by the Lessee. Under no circumstances shall this penalty be considered as rent, nor shall it give any right whatsoever to the defaulting Lessee. in case the Lessee unilaterally terminates this Agreement before the expiration of the Agreement, the Lessee accepts to pay an amount of one year's Minimum Guaranteed Rent as penalty.
