في يوم الاثنين بتاريخ 13/2/1419هـ الموافق 8/6/1998م فيما بين الموقعين أدناه كل من :حكومة سلطنة عمان (وتنوب عنها وزارة المالية) ويمثلها في التوقيع على هذا العقد معالي احمد بن عبد النبي مكي وزير الاقتصاد الوطني المشرف على وزارة المالية نائب رئيس مجلس الشؤون المالية وموارد الطاقة .(طرف اول)وــ بنك مسقط الاهلي العماني (ش.م.ع.ع) ويمثله في التوقيع على هذا العقد الفاضل / مدير عام البنك .(طرف ثان)تمهيد في إطار تنفيذ نظام الدعم المالي للقطاع الخاص في بعض المجالات الاقتصادية والخدمية الصادر بالمرسوم السلطاني رقم 17/97 ولائحته التنفيذية الصادرة بقرار معالي وزير الاقتصاد الوطني المشرف على وزارة المالية رقم 135/97 وتعديلاتها فقد تم الاتفاق بين الحكومة والبنك المذكور على ان يتولى تقديم القروض الميسرة وصرفها الى المستفيدين وتحصيلها وفقا لاحكام النظام ولائحته التنفيذيه وتعديلاتها المشار اليها ، ووفقا لما يلي :1 ــ يعتبر التمهيد السابق وخطاب الضمان المرفق جزءا لا يتجزأ من هذا العقد .2 ــ يلتزم الطرف الثاني بتمويل القروض الميسرة المشار اليها وادارتها وصرفها طبقا للهيكل التمويلي المرفق بمستندات القرض لكل مستفيد من المستفيدين الذين صدرت قرارات بتقديم القروض الميسرة اليهم وفقا لاحكام المادة (23) من اللائحة التنفيذية وتعديلاتها المشار اليها ، كما يلتزم بتحصيل الاقساط والعائد المستحق في المواعيد المقررة ومتابعة هذا التحصيل . ولا تكون الحكومة مسئولة في حالة تقديم القرض وصرفه دون مراعاة الاحكام والشروط الواردة في نظام الدعم المالي ولائحته التنفيذية وتعديلاتها المشار اليهما .3 ــ يتولى الطرف الثاني بعد اخطاره وفقا للمادة (24) من اللائحة التنفيذية وتعديلاتها المشار اليها ابرام عقد قرض مع المشروع ينظم الحقوق والالتزامات المتبادلة بين الطرفين ، ويتم التوقيع على العقد من قبل الممثل القانوني للمشروع ، ويجب ان يتضمن العقد بصفة خاصة الالتزامات المنصوص عليها بالمادة (26) من هذه اللائحة وتعديلاتها . وعلى الطرف الثاني ارسال نسخة من هذا العقد الى كل من الطرف الاول ووزارة التجارة والصناعة .4 ــ يتولى الطرف الثاني صرف القرض الى المشروع وفقا لعقد القرض المبرم بينهما طبقا للبند (3) وبمراعاة النظم المطبقة لديه والاحكام المنصوص عليها في نظام الدعم المالي للقطاع الخاص في بعض المجالات الاقتصادية والخدمية ولائحته التنفيذية وتعديلاتها المشار اليهما . ولا يجوز صرف القرض الا بعد مراعاة ما يلي :

As part of the implementation of the financial support system for the private sector in some areas of economic and service issued by Royal Decree No. 17/97 and its executive regulations issued by the decision of His Excellency the Minister of National Economy supervising the Ministry of Finance No. 135/97 and its amendments, it was agreed between the government and the said bank to provide concessional loans and disburse them to the beneficiaries and collect them in accordance with the rules of the system and its executive regulations and amendments referred to, according to the following:

2- The second party is obliged to finance the concessional loans referred to, manage and disburse them in accordance with the financing structure attached to the loan documents for each beneficiary who has been issued decisions to provide concessional loans to them in accordance with the provisions of article (23) of the regulations and their amendments referred to, as well as the collection of installments and the due return on schedule and follow-up of this collection.
The government shall not be responsible in the case of the provision of the loan and its disbursement without taking into account the terms and conditions contained in the financial support system and its executive regulations and amendments referred to.
3- The second party shall, after being notified in accordance with article (24) of the executive regulations and its amendments referred to, conclude a loan contract with the project regulating the rights and obligations exchanged between the two parties, and the contract is signed by the legal representative of the project, and the contract must include in particular the obligations stipulated in article (26) of this regulation and its amendments.
The second party should send a copy of the contract to both the first party and the Ministry of Trade and Industry.
4- The second party shall disburse the loan to the project in accordance with the loan contract concluded between them in accordance with article (3) and taking into account the regulations applied to it and the provisions stipulated in the system of financial support to the private sector in some areas of economic and service and its executive regulations and amendments referred to. It is not permissible to disburse the loan until it is taken into account:
