أنا المواطن محمد صاحب كشك لبيع المأكولات السريعة الساكن محافظة عدن
بتاريخ وعند حوالي الساعة 1430 بعد الظهر حدثت مصادمات في منطقة العدن بين محمد وبعض العناصر المسلحة وبعدها بلحظات انقطع صوت العيارات النارية ثم دوى صوت انفجار قوي قيل أنه صاروخ وقع على مدرسة ابتدائية داخل شارع العدن فهرعت الناس باتجاه المدرسة لمعرفة مصير أطفالها وفي هذه اللحظات كان علي واقف في مدخل القرية (عدن) فعندما شاهد علي الجماهير مهرعة نحو المدرسة أخذ بإطلاق نيرانه عشوائيا باتجاه الناس وعند عبور ولدي المجني عليه (قصي) من فرن الصمون المقابل للكشك أصيب بلق ناي من قبل علي في الجهة اليمنى من ظهره ونفاذها من الجهة اليسرى من صدرة مما أدى إلى وفاته.
أقمنا الدعوى المرقمة 123 لأجل التعويض وبعدها تم إبلاغنا برفض الدعوى.
عليه نقدم طلبنا هذا لغرض استئناف القرار.
علمًا أننا رأينا علي هو الذي قام بقتل ولدي المجني عليه قصي.
