The rights assignable have to be such of performance or payment by
the debtor.
Not included therefore are rights to performance by third parties or
rights to performance by the debtor under a different contract than the one
entered into with the creditor.
For the sake of clarity the term ‘agreement’ is used in the same context as in the Convention,describing the agreements within its scope (charge, conditional sale, lease and sale), whereas acontract shall describe a contractual relationship between the parties not falling within the scope of the Convention
