Debtor and Creditor have to be situated in different states, whereas the debtor has to be situated in a Contracting State, at the time of conclusion of the agreement creating or providing for the International Interest. This condition is called the connecting factor. Article 4, CTC provides for a number of ways in which the test of situation of the Debtor in a Contracting State can be satisfied.
