In an international convention such as this,
an express limitation to one applicable law
selected by the Convention terms is itself
meaningful and indicates the express intention
of the Convention to limit the breadth of the
NCRI validity and effect thereof under the
Convention to that governed by the law of the
declaring Contracting State, unless modified by
a further express provision such as the Article
40 provisions that allow for the registrable
NCRI to be registered and, whether or not so
registered, to then be ‘regulated accordingly’.
